Terms of Service

1. Acceptance of Terms

By accessing or using CryptoMarket ZA("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

2. Eligibility

You must be at least 18 years old and legally capable of entering into agreements under South African law to use this Platform. By registering, you confirm that you meet these requirements.

3. Account Responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must provide accurate and complete information during registration.
  • You are responsible for all activity that occurs under your account.
  • You must immediately notify us of any unauthorised use of your account.

4. Listings & Content

  • You must have legal ownership or authority to sell any item you list.
  • Listings must be accurate and not misleading. Prices must be stated in South African Rands (ZAR).
  • Cryptocurrency equivalents are calculated automatically and are indicative only.
  • You retain ownership of your content but grant us a licence to display it on the Platform.

5. Prohibited Content

You may not list or promote:

  • Stolen goods or property you do not own.
  • Illegal drugs, weapons, explosives, or regulated substances.
  • Counterfeit goods or items infringing intellectual property rights.
  • Fraudulent schemes, scams, or pyramid/Ponzi schemes.
  • Items that violate South African law, including FICA and POCA regulations.
  • Content that is hateful, discriminatory, or harassing.

We reserve the right to remove any listing and suspend any account that violates these rules without notice.

6. Cryptocurrency Transactions

  • CryptoMarket ZA is a classifieds platform only. We do not facilitate, process, hold, or escrow cryptocurrency payments.
  • All cryptocurrency transactions occur directly between buyers and sellers, peer-to-peer.
  • Cryptocurrency transactions are irreversible. Always verify wallet addresses before sending any payment.
  • We are not responsible for any loss resulting from incorrect wallet addresses, failed transactions, or price volatility.
  • Users are solely responsible for complying with South African tax obligations related to cryptocurrency transactions (SARS).

7. Crypto Pricing Disclaimer

Cryptocurrency prices displayed are sourced from South African exchanges (Luno, VALR) and are indicative only. Actual transaction prices may differ due to market volatility, exchange spreads, and network fees. CryptoMarket ZA does not guarantee the accuracy or timeliness of displayed prices.

8. Limitation of Liability

To the fullest extent permitted by South African law:

  • The Platform is provided "as is" without warranties of any kind.
  • We are not liable for any loss, damage, or injury arising from transactions between users.
  • We are not liable for any cryptocurrency losses, including but not limited to: sending to wrong addresses, price fluctuations, or blockchain network failures.
  • Our total liability shall not exceed the fees paid by you to us in the 12 months preceding the claim (if any).

9. Dispute Resolution

Any disputes arising from these Terms shall be governed by the laws of the Republic of South Africa. Disputes shall first be addressed through good-faith negotiation. If unresolved, disputes shall be submitted to the jurisdiction of the South African courts.

10. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time. Upon termination, your listings will be removed but we may retain certain data as required by law.

11. Changes to These Terms

We may update these Terms at any time. Material changes will be communicated via email or notice on the Platform. Continued use after changes constitutes acceptance.
